This is a beautiful secluded native grass section with a dirt tank on top of the mesa and a windmill in the southeast corner of the section. The Sierrita de la Cruz Ranch is a beautiful 3,328 +/- acre grazing and hunting ranch that lies along Bush Creek and the Sierrita de la Cruz Creek in the western Texas Panhandle. This Ranch is the north end of the original Frying Pan Ranch established by the family in 1881. Tabletop mesas offered 20-mile views, while the native grass, live water, and brush provide good habitat for antelope, whitetail deer, and mule deer. You will enjoy the peaceful seclusion this Ranch has to offer, while being just a short 18 mile commute to  Amarillo, the largest city in the Texas Panhandle.

The auction will take place at 2:00 pm on Tuesday, September 20, 2022 at the Amarillo Country Club, 4800 Bushland Blvd. Amarillo, TX. 79106. If you cannot attend this auction, remote bidding by phone will be available. Plan to attend the Auction Information Meeting at 1:30 pm on Tuesday, August 30th at the Amarillo Country Club. This is a great opportunity to learn more about this Ranch and the bidder’s choice auction process.


PROCEDURE:  These  3,328 + acres will be offered in five (5) individual tracts.  This is a Bidder’s Choice Auction. The highest bidder earns the right to choose one tract, multiple tracts, or the entire ranch at their submitted bid. After the highest bidder has made their selection of tracts in the first round of bidding and those tracts have been marked as Sold, the second round of bidding will begin on the remaining tracts. The highest bidder of the second round earns the right to choose the tract or tracts they wish to purchase from those remaining tracts. This process will continue until all five tracts are sold. 

BUYER PREMIUM: A 5% Buyer Premium is in effect for all purchases. The Buyer Premium will be added to the “Auction Board Price” to determine the “Total Sales Price” or “Total Contract Price”. 

ACCEPTANCE OF BID PRICES:  All successful bidders will sign a purchase agreement at the auction site immediately following the close of the auction.  All final bid prices are subject to the Seller’s approval.

EARNEST MONEY: Ten percent (10%) earnest money on the day of the auction, upon signing a purchase agreement immediately following the close of bidding. The earnest money may be paid in the form of personal check, business check, or cashier’s check. The remainder of the purchase price is payable in cash at closing. YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING, so be sure you have arranged financing, if needed, and are capable of paying cash at closing.

REAL ESTATE TAXES AND ASSESSMENTS: The Property Taxes will be prorated to the date of closing. Seller shall have paid all Property Taxes for prior years before closing.  The Buyer(s) will be responsible for any “rollback” in the property taxes. The Buyer(s) will be responsible for all additional taxes imposed after the date of execution of the Special Warranty Deed by seller as a result of any change in use of any part of the subject property, the intent being that all such additional taxes shall be the responsibility of the Buyer(s) and the Buyer’s heirs, personal representatives and assigns.

CLOSING: Will take place on or before November 1, 2022, or as soon as applicable closing documents and surveys (if needed) are completed. 

POSSESSION:  Possession will be given at closing.

TITLE: Seller shall provide an Owner’s Policy of Title Insurance on the surface tracts in the amount of the purchase price. Buyer(s) will be responsible for all expenses related to acquiring a mortgagee’s title policy, if required.  Seller shall execute a Special Warranty Deed conveying the real estate to the Buyer(s).

PROPERTY CONDITION:  Property to be sold AS IS—WHERE IS and no warranty or representation, either express or implied, will be given to any bidder or Buyer.  Buyer(s) shall release Seller of any and all liability.

EASEMENTS AND LEASES: Sale of the property is subject to any and all easements of record and any and all leases. Current grazing leases will expire upon closing.

SURVEY:   If a survey is needed to close the sale to a single Buyer of all of the properties, the cost of that survey shall be at such Buyer’s cost and expense.  If a survey is needed to close the sale to a Buyer of less than all of the properties in order to plot any easements created, the cost of such survey shall be at the cost and expense of the Seller(s) of the Tract(s). All advertised acreages are approximate and have been estimated based on current legal descriptions and/or aerial photos. See purchase agreement for details of price adjustments.

MINERAL RIGHTS:  No oil, gas or other minerals will be conveyed. All executive Wind Rights will be conveyed to the Buyer(s). Each Owner will retain one-half (1/2) of the Owner’s Wind Rights to the extent allowed by Texas law.
